 L/C CHECKLIST FOR BUYER & SELLER


(A ) Opening a Letter of Credit (Buyer's Checklist):

1. Detailed Contract: Ensure that there is a comprehensive sales contract or agreement between the buyer and the seller, clearly outlining the terms and conditions of the transaction.

2. Agreed Incoterms: Confirm the agreed-upon International Commercial Terms (Incoterms) specifying the responsibilities and costs of both parties regarding the shipment and delivery of goods.

3. Correct Beneficiary Details: Verify the correct and complete details of the beneficiary (seller), including name, address, and any specific instructions for payment.

4. L/C Type and Terms: Clearly define the type of L/C (e.g., irrevocable, confirmed) and specify the terms, such as the expiration date, shipment terms, and payment conditions.

5. L/C Amount: Clearly state the L/C amount in the agreed currency, ensuring it covers the total value of the goods and any additional costs.

6. Documents Required: Clearly list the documents required for presentation under the L/C, including but not limited to the commercial invoice, bill of lading, packing list, certificate of origin, and inspection certificates.

7. Shipment and Presentation Period: Specify the time frame for shipment and the period during which documents must be presented to the issuing bank for payment.

8. L/C Advising Bank: Specify the bank through which the L/C will be advised to the seller. Provide complete contact details.

9. Applicable Law and Jurisdiction: Define the governing law and jurisdiction in case of disputes arising from the L/C transaction.


( B) Responding to a Letter of Credit (Seller's Checklist):

1. L/C Verification: Verify the authenticity of the L/C and confirm that it aligns with the terms of the sales contract.

2. Ensure Compliance: Confirm that the terms and conditions of the L/C are feasible and can be met by the seller.

3. Document Preparation: Prepare and review all required documents meticulously to ensure accuracy and compliance with L/C terms.

4. L/C Amendments: If necessary, request amendments to the L/C to align with the sales contract or resolve any discrepancies.

5. Shipping Instructions: Ensure that the goods are shipped according to the specified Incoterms and any other shipping instructions in the L/C.

6. Inspection and Certification: Arrange for any required inspections and certifications to comply with L/C requirements.

7. Communication with Banks: Maintain clear communication with the advising and confirming banks, providing them with necessary information and updates.

7. Notify Shipment and Documents: Notify the buyer of the shipment details and send the required documents to the advising bank promptly.

8. Monitor Payment: Monitor the payment process closely, ensuring that funds are received in accordance with the L/C terms.

9. Record Keeping: Keep thorough records of all documents, correspondence, and transactions related to the L/C.
